This is the commercial carve out which doesn't make much sense and should probably be repealed. That being said it will be framed as the first step to repealing the whole thing and as you said, I don't think that would be popular.
Agree that it wasn't ideal, but I have sympathy for someone who was tired of being made a fool of and wasn't looking to be made a fool of again that night (which would be the case if she went to the trouble of making the food only to have the dude laugh and say he'd changed his mind regardless of whether or not he got the food).
